Information on the processing of personal data, pursuant to Article 13 of EU Regulation 2016/679

Pursuant to Article 13 of EU Regulation 2016/679 (henceforth GDPR) we hereby inform you that the personal data acquired is processed, including by automated means, by EnginSoft SpA, to access to the contents presents in the LinkedIn Smart-Links and for sending communications about future events, initiatives and activities by EnginSoft SpA and/or its subsidiaries and partners.

1. Data Controller

EnginSoft SpA, with it registered office in Trento (Italia), Via della Stazione 27 – Frazione Mattarello, in the person of the CEO is the data controller of the personal data processing.
The Data Controller has appointed a Data Protection Officer (DPO) who can be contacted at the email address: dpo@enginsoft.com.
The data subject’s personal data is processed by person authorized by the data controller and by data processors specifically appointed and instructed by EnginSoft SpA.
In addition, the data subject’s personal information may be transferred to other data controllers with the specific consent of the data subject.

2. Personal Data Collected

The collected personal data includes: identifying, contact and personal information (name, surname, date of birth, email address, job role, company, mobile phone, role and function). The personal data are the information shared directly by the data subject using the LinkedIn services. These personal data are processed by EnginSoft contextually to the consent acquisition.

3. Purposes of Processing

The purpose of the processing of personal data is for sending communications about future events, initiatives and activities by EnginSoft SpA and/or its subsidiaries and partners.
The legal basis of processing is the consent as art. 6, section1, letter a of the EU Regulation 2016/679.

4. Retention period

Personal data collected will be processed until interested to activities and news provided by EnginSoft SpA or until withdrawal of consent from the data subject.

5. Categories of recipients

In relation to the purposes indicated, the data may be transferred to companies and/or persons who provide services, including external services, on behalf of the data controller for conservation and to guarantee the service. The data you provide may be included in the institutional mailing platform, for the sending of newsletters and scientific magazines.

6. Provision and nature of the data

The provision of data is voluntary.
The refusal to provide data involves the inability to access to the contents presents in the LinkedIn Smart-Links.
The legal basis of processing is the consent as art. 6, section1, letter a of the EU Regulation 2016/679. The consent is expressed by clicking on the button presents in the form using to access the LinkedIn Smart-Link.

7. Rights of the data subject

The data subject, in relation to the personal data that is the subject of this notice, has the right to exercise the rights provided by the GDPR described below:

  1. Right of access of the data subject (Art. 15 of the GDPR): the right to be informed about the processing operations performed on one's personal data and, if necessary, to receive a copy thereof.
  2. Right to rectification of one's personal data (Art. 16 of the GDPR): the data subject has the right to rectify inaccurate personal data concerning him- or herself.
  3. Right to erasure of one's personal data with no undue delay (Art. 17 of the GDPR): the data subject has, and will have, the right to the erasure of their data ("right to be forgotten").
  4. Right to restriction of processing ( Art. 18 of the GDPR): in the case of, inter alia, unlawful processing or contestation of the accuracy of personal data.
  5. Right to data portability ( Art. 20 of the GDPR): the interested party may request their personal data in a structured format in order to transmit it to another owner, in the cases provided for by the same article.
  6. Right to object to the processing of their personal data ( Art. 21 of the GDPR): the data subject has, and will have, the right to object to the processing of their personal data.
  7. Right not to be subjected to automated decision-making processes (Art. 22 of the GDPR): the data subject has, and will have, the right not to be subjected to a decision based solely on automated processing.

EnginSoft Spa, in accordance with Article 19 of the GDPR, undertakes to inform any rectification or erasure of personal data or restriction of processing to the recipients to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. With reference to the above-mentioned purposes, the data subject has the right, at any time, to delete or withdraw his/her consent to the processing of his/her identification and personal data by sending an email to: dpo@enginsoft.com

In accordance with Article 7 of the GDPR, withdraw of consent shall not affect the lawfulness of processing based on the consent before its withdrawal.
Pursuant to Art. 77 of the GDPR, the data subject who alleges that the processing of his/her personal data infringes the Regulation, or if the response to a request related to the rights listed above is not satisfactory, may apply to the judicial authority or to the Data Protection Authority, in the latter case by lodging a complaint according to the national procedures: www.gpdp.it/modulistica-e-servizi-online/reclamo.
